Pro-life groups call ruling a 'victory for justice'
Judge: Criminal case against Tiller can proceed
Judge Clark Owens ruled this afternoon that a criminal case against late-term abortionist Dr. George Tiller can proceed.
Owens, a Sedgwick County District Court judge, denied motions filed by Tiller’s attorneys that evidence be suppressed or the case be dismissed. That clears the way for a trial to begin March 16.
Tiller is accused of 19 misdemeanor counts of failing to get an unaffiliated physician to concur that late-term abortions were medically necessary, as required by Kansas law.
Cheryl Sullenger, senior policy analyst for Operation Rescue, commended Judge Owens for seeing through the “smoke-and-mirrors” tactics of Tiller’s lawyers. She called the ruling a victory for justice.
Mary Kay Culp, executive director of Kansans for Life, said simply: “Thank goodness.”
The investigation was initiated by then-Attorney General Phill Kline, the charges were filed by his successor Paul Morrison, and the case is now being prosecuted by the office of Morrison's successor, Steve Six.
