Bill would include an end to in-state tuition breaks for illegal aliens.
Tactics will change, but goals of immigration reform advocates remain the same
Rep. Lance Kinzer, the Olathe Republican who sponsored a comprehensive immigration reform bill that failed to make it through the 2008 Legislature, said lessons learned during that campaign will guide his latest effort to crack down on illegal immigration.
Kinzer, the newly appointed chair of the House Judiciary Committee, told Kansas Liberty Monday that he may have over-reached in attempting to pass the comprehensive reform package and that he would attempt an incremental approach after the Legislature convenes in January.
He said a more limited bill might have a higher likelihood of success, thus building momentum that could be a springboard for other legislative initiatives in the coming session and beyond.
“Getting something is better than nothing, and I didn’t think, tactically speaking, that fighting last year’s battle all over again was the way to go,” Kinzer said.
In discussing specifics, Kinzer said his bill would include components to eliminate a Kansas law that allows illegal aliens to pay in-state tuition to attend state universities. In addition, the bill would create a presumption that illegal aliens who are arrested pose a flight risk, meaning they would generally not have an opportunity to post bond and be freed before standing trial. Finally, the bill would compel law enforcement agencies to verify the citizenship of arrested parties.
He pointed out that a California bill that would have ended in-state tuition for illegal immigrants passed constitutional muster before a state appeals court earlier this year. Outgoing Kansas GOP Chair Kris Kobach was among lawyers who argued in favor of the bill’s constitutionality. Kobach is assisting in crafting the bill Kinzer plans to introduce.
Given the state’s dire budget situation, Kinzer said he was purposely attempting to draft a bill that would have little impact on the state’s bottom line.
“I’m trying to limit the fiscal note as much as possible, and this would not have much of a price tag,” he said.
The bill will be partly defined by what it does not include. Last year’s bill, for example, included a provision that would have compelled small businesses to verify a prospective employee’s citizenship. The bill also included penalties for businesses that hired illegal immigrants. Both provisions were generally opposed by business advocates.
Kinzer said he continued to believe those provisions were needed but that he didn’t want to see a new bill bogged down over the same conflict.
“It’s not fun to back off, but I believe it’s crucial to create momentum that we can build on,” he said.
Kinzer said he was unsure at this point whether he would seek House co-sponsors and introduce a bill personally, or whether he would seek to have the bill initiated by the House Judiciary Committee.
“I haven’t made a final determination on how to proceed,” Kinzer said.
He said he would circulate a draft of the bill to House and Senate colleagues before introducing it.

Well, this is a VERY GOOD start. Why should ILLEGAL ALIENS be able to use our schools when by law, they shouldn't even be here! This illegal immigration has caused more problems than anyone could have ever imagined!
I can’t say the ILLEGAL ALIENS are completely to blame for the shape of our economy, but they are a BIG part of the problem. The ILLEGAL ALIENS send BILLIONS upon BILLIONS out of this Country every year, money we will NEVER see again. Does this help our economy?
How about the BILLIONS the American taxpayers fork out for the ANCHOR BABIES, the schooling of them, the medical care and the list goes on, and on, and on.
How about the MILLIONS upon MILLIONS paid to jail ILLEGAL ALIENS for the crimes, then the cost to deport them. Does this help our economy?
Then you have these so called activist groups that want AMNESTY for these ILLEGAL ALIENS. It would be absolute suicide for this Country if AMNESTY were granted to the 20 million or so ILLEGAL ALIENS. We have more and more people out of work everyday and they want to add another 20 million to this Country? I say, “NO”!
If AMNESTY were ever granted to these 20 million ILLEGAL ALIENS, you can bet big money that 3 years from now, there would be ANOTHER 3-5 million ILLEGAL ALIENS demonstrating on our soil for AMNESTY. I don’t wish to lose my privilege on this site, so I will refrain from using the words that fit here.
An end MUST come to this illegal immigration. The perfect tool we have so far is E-Verify. It MUST be used on ALL businesses and Government Social Services. EVERY employee must be checked! If they are illegal, they are to be dismissed and deported!
I believe it is time for all 50 States to pass a State law, like Arizona, Oklahoma, Mississippi, Missouri, South Carolina and a few others. It is time for these ILLEGAL ALIENS to go back to their home Country and get out of this Country. The problems they are causing will not go away until the ILLEGAL ALIENS are out of this Country. I think that is plain to see.

rep. Kinzer's bill to stop in-state tuition for illegals
Hurray for Kinzer!!! Frankly this is not a money / budget issue at all but one of fundamental fairness and the rule of law.
Thanks primarily to Senator John Vratil and Reginald Robinson; President and CEO of the Kansas Board of Regents, Kansas taxpayers have been forced to pay for part of illegal aliens’ college tuition for years even though many Kansas citizens have found it tougher and tougher to pay their own way or that of their kids to college. (1) What is even more disgusting is the documented discussions by Senator Vratil and Robinson, both participated in the Legislative Educational Planning Committee (LEPC) on how to circumvent the federal law against discriminating against U.S. citizens in favor of illegal aliens so that the bill would in fact discriminate against U.S. citizens.
Yes that is right the current Kansas in-state tuition law violates federal law 8 U.S.C. 14 Section 1623. This was clearly pointed out to the schemers by others advising the LEPC. A Senator that puts non-citizen’s interests above the interests and desires of citizens is not worthy to serve in a representative capacity. Nor should a state employee be entitled to maintain their job when they do so and / or scheme to violate federal law especially to work a disadvantage on their fellow citizens (and employers.)
Beyond the costs of subsidizing illegal aliens, about $11,000 per year per illegal at KU, what cost does one place on the damage done to the rule of law? One of the facts these illegals have to show to qualify for the special treatment (in-state tuition) is that they or their parents have broken federal law and that they intend to continue to do so. As an offspring of an illegal alien they are deportable. Once they turn 18, presumably shortly after graduating from high school and while in a Kansas College, they are personally legally liable for remaining in the United States illegally. At least one court has found the requirement that such illegals sign an affidavit they will attempt to gain “legal status" is a farce and non-enforceable to boot. Also there is no way for such illegals to change their legal status other than returning to their home country and properly filling out the immigration paper work and waiting for their turn in line (the American thing to do any way.) If these illegals are caught they are deportable, in spite of whatever special privileges Senator Vratil and Mr. Robinson may desire to confer upon these illegals, and they may not apply for entry for a period of ten years. In short whose interest Vratil and Robinson sought to serve it was not that of the Kansas taxpayer nor of the illegals. Perhaps it was El Centro Inc, an ethno-centric group who openly attempt to assist and make illegals life easier at U.S. citizens expense or that of the Chamber of Commerce upon whose behalf Senator Vratil openly “gutted” the Palmer bill last session, which was to be a taxpayer protection act including to stop in-state tuition for illegals but which Vratil tuned into a protection act for illegal alien and business unlawfully hiring illegal aliens.
More power to Kinzer and the representatives that support the return to the rule of law and representation of the citizens of Kansas. Its about time. Now it's our (citizens) job to support Kinzer!

Attack on Kinzer and Kobach begin
Already the loyal opposition to the rule of law and representative government for U.S. Citizens has started even before the start of the Kansas 2009 legislative session!!
Susan Lynn, the editor of the Iola Register (in the southeastern county of Allen), published an editorial playing the race (baiting) card. She said:
“…For Anyone who has broken bread with his Hispanic brother, the target of Kinzer and Kobach, he knows these people are here for the sole purpose of survival, and in the case of education, for progress, including ours….”
What rubbish!!!!! First, just exactly what does Lynn mean by “these people”!? It appears she is stereo-typing all Hispanics. I thought this was a “no no”, a mere “racist” technique! The truth of the matter is that our federal prison population is comprised of about one third “criminal aliens”. Honest people do not suggest all Hispanics are criminals, Ms. Lynn should not suggest that none of them are criminals.
I do point out that by definition all illegal aliens are “criminals” as they violated federal law by violating our sovereign borders. To the extent they are working in the U.S. ( the reason Ms. Lynn attributes they are here) they have violated even more of our laws including more violations of the 1986 law prohibiting them from working here, conspiracy to violate such laws, perjury to the extent they are formally stating they are eligible to work here, identity thief if they are using someone else’s identity, document fraud to the extent they are using forged documents to work, voter registration fraud to the extent they have registered to vote to use their voter id card to meet the federal I-9 proof of eligibility to work etc. etc. (The voter registration issue is a real problem in Kansas which Ron Thornburgh, Kansas Secretary of State, refuses to do anything about! This came about by the Secretary of Revenue, Joan Wagnon, giving special treatment to non-citizens. For more information on this issue contact me.)
Second, Ms. Lynn slanders both representative Kinzer and professor Kobach by stating they are “target[ing]” Hispanics. I have never heard or read anything that even remotely suggests let alone where either of these gentlemen state they are targeting “Hispanics”! Of course Lynn failed to cite any source to prove her slanderous assertions. Frankly this editor needs to put up or shut up. She suggests they are out to get immigrants which of course are grossly untrue as well.
If I were one of the “‘K’ brothers”, as she refers to Kinzer and Kobach, I would strongly considering suing her and her [ig] noble rag. (I am sure it is an accident Ms. Lynn is one “K” from “KKK” with this reference.) Such would serve as a warning to others of Lynn’s ilk to think twice about race baiting and slandering those who are in fact speaking the truth and trying to fulfill their duty to the citizens of this state and this Great Nation. A law suit would serve the even more important role of educating the public to the dishonest and scurrilous techniques used by those who oppose the rule of law and representative government in an attempt to scare those who would speak the truth but for fear of being called a racist.
The only basis one might even assume “Hispanics” are being “targeted” is the fact that over ½ of the illegals in this country are Mexican nationals and almost another 1/3 is Hispanic primarily from South and Central America. That is not Representative Kinzer’s or professor Kobach’s doing, that is just the truth of the matter. (This is according to data generated within the Department of Homeland Security (DHS).
Third, Ms. Lynn continues with her deceptions by saying that:
“… the federal E-Verify program to check the papers of new hires was found wanting because the social Security data base it draws upon is error-ridden and has led to job denials for American citizens and legal immigrants….”
The “E-Verify” system is the only remaining of three pilot systems which began development after 1986 to enable employers to verify the employment eligibility of job applicants. (As the courts and the executive government have acknowledged the current I-9 system does not work and has resulted in the number of illegals soaring from over 3 million to 12-20 million. This is the system currently used in Kansas.) The E-Verify system, according to independent consultant studies (Westat) conducted on 2007 data and by DHS, indicate it, as of that time, had an accuracy rate of 99.5%. There have been improvements since. Ninety three percent (93%) of the checks are accurately returned within five (5) seconds. Almost 95% are returned within 24 hours. The majority of delays beyond this time period are due to individuals not providing various government agencies information they are required to provide i.e. are self made problems.
These issues do not delay anyone from getting a job as the employment decision, under the law, is required before the E-Verify system is used. One may not fire someone because the initial check comes back unverified. By law the new employee has time to clarify the ‘problem’ with the government before they may be terminated. Most problems are because of name changes and reason changes in immigration status.
Although some, like the Chamber of Commerce, insist the use of E-Verify is onerous and costly the truth, as found by at least one federal court, is that the average set up cost of E-Verify is $125.00 with 85% spending less than $100.00. The average operational cost is $ 728 with 75% of those who use the system paying $100.00 or less annually. Money well spent to ensure Americans work and get a livable wage.
Strike three! Ms. Lynn your credibility is OUT!

How do you explain to the legal aliens working here or on student visas that they must pay out of state tuition rates, if they wish to attend a Kansas college or tech. school. Worse yet a citizen from another state must pay out of state rates . The lesson is come here illegally and you will get special rights granted to you and only you. This is wrong ! Mr. Fry points out that it is a violation of Federal Law to do this. What does it say about the character of Senator Vratil and others that I believe , knew it was against Federal law and knew most citizens were not in favor of Instate tuition for illegal aliens but voted it in to Kansas law any way! Who do these people represent the citizens or special interest? Let's support Lance Kinzer and other Representatives that want to bring Kansas back in line with our nations laws .
